Perak Becomes the First State to Allow Online Divorce Applications
Divorce is the dissolution of a valid marriage before a judge based on legal requirements. In Islam, divorce is a last resort and is something highly discouraged, though permitted for specific reasons and circumstances. Divorce can be carried out through talak, fasakh, and khuluk or tebus talak (redemption of divorce).
In this modern era of information technology, everything is at our fingertips, including simplifying the process of filing applications for Muslim couples seeking a divorce. A system known as MySolve has been developed to make it easier for couples experiencing marital issues to file for divorce. This system has been in development since early 2016. Interestingly, the implementation of this system has indirectly made Perak one of the first states to introduce an online divorce application portal known as MySolve, which is the first of its kind in the world. The Chairman of the State Committee for Islamic Religion, Islamic Education, and Personality Development,
Dato Drs Mohd Nizar Zakaria
, stated that this system is not intended to encourage married couples to divorce, but rather to serve as a facilitator for them to resolve arising domestic issues.
Through the MySolve system, couples experiencing marital issues who wish to register for a divorce no longer need to visit the Syariah Court repeatedly, as all relevant information is stored and recorded in the system once their application is submitted. For your information, this system was developed by the Perak Syariah Judiciary Department and can be accessed at mysolve.perak.gov.my via computer or mobile phone. The Chief Syarie Judge of the Perak Syariah Judiciary Department, Asa'ari Mohd Yazid, said the MySolve system, which has been in development since January 2016, was created in collaboration with the Perak State Development Corporation. He stated that through MySolve, divorce applications can be resolved within a maximum of one week, compared to the usual procedure which takes up to two months, making it more effective and efficient for resolving couples' issues. The existence of the MySolve system helps save costs and time for couples seeking a divorce when dealing with the Syariah Court. Furthermore, it benefits the court by ensuring couples receive appropriate hearing dates, reducing congestion at court counters, and making case scheduling more organized. Those using the MySolve system will be charged a registration fee of RM50 for each divorce application.
